The first step in protecting your brand through trademark registration is deciding on a trademark that stands out from the crowd. The next stage is to determine which category the mark will fall into. Registration of a trademark can be done in 45 different “classes” of goods and services. Products fall under classes 1-34, while services are categorized in classes 35-45.

After settling on a mark, it’s important to conduct a trademark search to see if it’s comparable to a previously registered mark. By checking the Indian Trademark Registry for identical trademarks previously registered in that class (or a related class), our Trademark Agent or Attorney can confirm whether or not the mark is registrable under trademark law.

Submitting a Trademark Application

As part of the trademark registration process, our trademark attorney will create a trademark application based on the search report of the proposed trademark. The proposed mark for filing may need to be revised or altered if the client’s mark is ambiguous or confusingly similar to an already registered trademark.

  • 1. Application

    A trademark application allotment number is typically issued within one or two business days. The applicant may then add the "TM" symbol.

  • 2. Vienna Codification

    When registering a trademark, the Registrar of Trademarks looks at the mark's figurative characteristics to determine where it belongs in the Vienna Classification.

  • 3. TM Journal Publication

    The Trademark Registry publishes a weekly publication called the "Trademarks Journal" in which trademarks that have been accepted for registration can be found. Within 4 months following publication, the public may file an opposition to the trademark registration.   • 4. Trademark Registration

    Indian Trademark Office trademark examiners review and authorize your trademark application after it has been filed with them. The trademark is registered with the Indian Trademark Office once it has been approved, and the symbol can then be used in conjunction with the mark to indicate that the mark is a registered trademark or service mark.
